NESTLÉ Stokvel Competition Terms and Conditions

  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with BSK Consulting CC trading as BSK Marketing (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
  2. By participating in this Competition, Participants agree to the rules set out below.

    This Competition is limited to legal residents and/or legal citizens of South Africa who are members of a stokvel or persons in the capacity of a representative of a stokvel within South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • 2.2. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.
    • 2.3. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • 2.4. Persons under the age of 18 years.
       
  3. The Competition is split into 2 phases:
    • 3.1. Stokvel Member Competition (“Phase 1”), which shall commence on 22nd July 2019 – 31st September 2019. No entries for Phase 1 received after 31st September 2019 will be considered.
    • 3.2. Stokvel Group Competition (“Phase 2”), which shall commence on 01st October 2019 – 16th December 2019. No entries for Phase 2 received after 16th December 2019 will be considered
       
  4. Mechanics
    • 4.1. To participate in this Competition, Participants must adhere to the following:
      • 4.1.1. Phase 1: A member of any stokvel should purchase at least one singular Participating Product (detailed below). Dial *134*403# and follow the prompts. USSD sessions are FREE. Please ensure you terminate the call when complete in order to stop the call.
      • 4.1.2. Phase 2: A stokvel group should purchase a minimum of two different product cases of the Participating Products. It is important to note that the purchase of the Participating Products must be made as a stokvel. Dial *134*403# and follow the prompts. USSD sessions are FREE. Please ensure you terminate the call when complete in order to stop the call.
    • 4.2. Participating Products:

    • 4.3. Participants of Phase 1 are allowed to enter as many times as they like as long as they purchase a Participating Product. For the avoidance of doubt, one entry for Phase 1 of the Competition shall be at least on purchase of a singular Participating Product. Participation in Phase 1 of the Competition is subject to the following conditions:
      • 4.3.1. All entries from disqualified participants’ mobile numbers will be rejected;
      • 4.3.2. Only one prize per household and per person will be permitted;
      • 4.3.3. No computer-based entries will be accepted;
      • 4.3.4. Any mobile number that enters an incorrect unique code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”).
    • 4.4. Participants of Phase 2 are only allowed one entry per stokvel (a single member will enter on behalf of a single stokvel), subject to the following conditions:
      • 4.4.1. All entries from disqualified participants’ mobile numbers will be rejected;
      • 4.4.2. Only one prize per household and per person will be permitted;
      • 4.4.3. No computer-based entries will be accepted;
      • 4.4.4. Any mobile number that enters an incorrect unique code five (5) times in succession will be locked out of the Competition for the entire duration of the promotional competition (“Blocked Participants”).
    • 4.5. Blocked Participants have an opportunity to call the Nestlé Call Centre on 011 514 6116 or 086 009 6116 between 09h00 – 16h30 Monday to Friday should there be a valid reason, which is accepted by the Promoter, for the Blocked Participants to be allowed to enter the Competition.
  5. The Prizes:
    5.1. Participants in this Competition stand a chance to Win:
    • 5.1.1. Phase 1: 4 x double tickets to the Stokvel Lifestyle Cruise at the Portuguese island. For the avoidance of doubt, 4 winners will be chosen by random draw, for Phase 1 who will each win 2 tickets to the Stokvel Lifestyle Cruise.
    • 5.1.2. Phase 2: 2 x Stokvel groups (max 14 members) tickets to the Stokvel Lifestyle Cruise at the Portuguese island. For the avoidance of doubt, 2 winners whose stokvel has purchased the most Participating Products will be chosen by the judges, for Phase 2. Each Stokvel will win 14 tickets (for 14 members) each to the Stokvel Lifestyle Cruise.
  6. The Stokvel Lifestyle cruise (SLC)
    • 6.1. The SLC embarks from Durban Port on the 31st January 2020 to the Portuguese Islands Mozambique and returns to Durban on the 3rd February 2020.
    • 6.2. The SLC is a theme cruise aboard the MSC and all attendees are the responsibility of Umnisi Creatives the under writing company behind the SLC event.
    • 6.3. The tickets include:
      • 6.3.1. All SLC Entertainment
      • 6.3.2. Four Meals per day ( breakfast, lunch, mid-day snack and dinner)
      • 6.3.3. Your Accommodation according to the cabin Type chosen
      • 6.3.4. All On Board entertainment provided by MSC Cruises
      • 6.3.5. Travel Insurance
    • 6.4. The Tickets Exclude:
      • 6.4.1. Flights and Transport to Durban Port and from Durban Port upon return from the cruise.
      • 6.4.2. Alcoholic drinks onboard
      • 6.4.3. Health requirements where necessary
      • 6.4.4. All items of personal nature
      • 6.4.5. Gratuities
      • 6.4.6. Meals and beverages other than specified
      • 6.4.7. Spending money
      • 6.4.8. Any other items not noted in the inclusions
    • 6.5. Winners are to ensure that they adhere to the MSC Cruises Terms and conditions for the duration of the cruise. These terms are to be found at: www.stokvellifestylecruise.co.za
  7. How to claim your prize:
    • 7.1. BSK will contact the Stokvel member and ask verification questions according to the information submitted on their entry as well as information relating to that member’s stokvel.
    • 7.2. Stokvel member will be asked to submit their till slip number and till slip.
    • 7.3. Phase 1 prize winners will be drawn monthly:
      • 7.3.1. Draw 1: first week of August 2019;
      • 7.3.2. Draw 2: first week of September 2019; and
      • 7.3.3. Draw 3: first week of October 2019.
    • 7.4. Phase 2 prize winners will be drawn in the last week of December 2019.
    • 7.5. Winners to send their full details to BSK
    • 7.6. All winning Stokvel groups to be notified by 27 December 2019 and BSK will take pictures of the prize winners.
    • 7.7. The potential prize winner is not an actual winner until his/her submission is validated, the verification questions answered to the satisfaction of the Promoters and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein. Potential winners have 48 hours to submit the relevant documentation before forfeiting the prize.
    • 7.8. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  8. General :
    • 8.1. The judges’ decision is final, and no correspondence will be entered into.
    • 8.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules.
    • 8.3. Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 8.4. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 8.5. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 8.6. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing [email protected] Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 8.7. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 8.8. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 8.9. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 8.10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 8.11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 8.12. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 8.13. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 8.14. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 8.15. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

  1. Introduction
    • A. Participation in this Competition is governed by these terms and conditions (the Rules).

  5. It is essential that the participating product be bought within the Competition period. USSD costs 20c/20sec. All unique/positive entries will be entered into a random weekly draw.
     
  6. Participants may enter the competition a maximum of 3 times per week over the Competition period, provided that Participants purchase any 2 participating products each time and keep valid copies of their till slips and enter a valid barcode, subject to the following conditions:
    • A. All entries from disqualified participants' mobile numbers will be rejected
    • B. Only one prize per household and per person.
    • C. No computer-based entries will be accepted.

  11. How to claim your prize:
    1. Sorbet Vouchers:
      At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as a copy of his/her ID and/or driver's license and a valid till slip to the Promoters representative.
    2. Le Creuset Pot Set:
      • At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as a copy of his/her ID and/or driver's license, a valid till slip and physical address for the delivery of their prize to the Promoters representative.
      • Once all required documents are received and verified by the representative of the Promotors, delivery will take place within 14 working days.
  12. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
  13.   4. The Prize:
    • 4.1. Participants entering the competition stand a chance to win prizes coordinated through a weekly draw. There will be a total of 10 x Le Creuset vouchers worth R1000 each. Two vouchers to be given away per week.

  4. Retail Mechanics

To participate in the competition, participants must purchase any 1 (one) of the following Nestlé products from any of the participating stores in Botswana during the promotional period and retain their till slips as proof of purchase. The participating stores will be recognisable by the in-store Points of Sale (POS):

    • 4.3. Participants may enter the competition as many times as they wish over the promotional period, provided that they purchase a participating product each time and complete the competition entry form.
    • 4.4. Only one prize per household and per person i.e. within the same family or immediate family residing in the same abode unless proof of purchase can be obtained.
    • 4.5. Any mobile number that is referenced in the entry form and is not contactable for a period of 2 days will be disqualified and a new winner will be drawn.
    • 4.6. The mobile number and email address provided on the entry form is key to all entries, if the entrant has won on a mobile number they cannot use another number in order to be contacted further, this number needs to be a number that is contactable during office hours.
    • 4.7. The winners will be determined by random draw within two weeks after the date of closure of the competition (this date is subject to change without notice). The draw will take place at each participating store, and will be conducted by a Nestlé representative at each store.
  5. The Prizes:
    • 5.1. Participants entering the competition stand a chance to win one of 50 (fifty) WEBER 47cm Compact Kettle worth ZAR1687.00 (one thousand six hundred and eighty seven Rand) each (the “Prize”). One winner will be drawn in each of the participating stores.
    • 5.2. Participants may only win one prize throughout the promotional period.
    • 5.3. Nestlé reserves the right, at its sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • How to claim your prize:
      • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of Nestlé, at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her proof of identity.
      • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to Nestlé. If a potential weekly prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up will be deemed the potential weekly prize winner subject to the terms and conditions herein.
      • 6.3. If Nestlé or the organisers of the competition are unable to reach any of the potential prize winners within 72 hours of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

      • 6.5. It is the responsibility of the winner to avail themselves to sign for the prize and collect their prize from the relevant participating store. No one other than the prize winner will be allowed to sign for the prize.       • 6.6. Should the winner not collect their prize from the relevant store within the 14 day period stipulated above, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.

    • 4.2. The Ultimate Food Experience includes:

    To participate in this Competition, Participants must adhere to the following:
    • 4.1. Participants in this Competition stand a chance to win their share of R200 000 in daily airtime in the following increments:

    1. Participation in this Competition is governed by these terms and conditions (the “Rules”).

    4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
  2. By participating in this Competition, Participants agree to the rules set out below.
    This competition is only open to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.

  3. Mechanics

Entrants must retain their proof of purchase. 

    It is essential that the participating product be bought within the Competition period. Network Data Charges apply.
    • 3.1. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (Free minutes do not apply).     • 4.7 The Promoters will not partake in any sort of deals if any of the winners decide to sell the bakkie once it has been handed over to the winner. The winner takes full responsibility for the selling of the bakkie and the risks associated with the sale.
    • 4.8 The bakkie will be delivered to the nearest selected dealership or a selected store in that region where each winner is located. Nestlé, the organisers of the competition and the promoters are not responsible for travel costs for the winner to get to the selected dealership or selected store in that region to collect the bakkie. The winner will be required to bring all relevant documents upon handover of the bakkie.
    • 4.9 The bakkie will be delivered within two months of the date which the draw took place. Nestlé will contact the winner should the delivery be delayed for whatsoever reason and the winner shall have no claim against Nestlé for any such late delivery.
    • 4.10 The winner must collect the bakkie within 2 weeks from the bakkie being delivered to the relevant dealership or the selected store and a failure to do so will result in the winner forfeiting the prize, without any claim or recourse against the Promoters.
  5. Claiming your Prize
    • 5.1 To claim the Prize, the Winner must produce their valid South African driver’s license.
    • 5.2 The Promoter will call the possible finalists on the cellphone number used to enter the Competition. The possible finalist will be called once a day for 3 (three) days and if the Promoter is not able to contact the possible finalist during this time, the Promoter will move onto the next possible Winner.
    • 5.3 The possible finalist will need to be verified and provide the Promoter with a certified copy of their South African ID/or Passport and South African driver’s license and complete a finalist form as well as a valid proof of purchase. Blurred or obscured copies or copies that have been tampered with in any way will result in disqualification. The requested documents need to be sent within 24 (twenty-four) hours. If the requested documents are not sent within 24 (twenty-four) hours the finalist will be disqualified and the Promoter will move onto the next possible finalist.
    • 5.4 If the possible finalists pass the verification process and submits the required documents stipulated above they will be declared a Winner by the Promoter. The validity of such documentation is at the Promoter’s discretion.
    • 5.5 Should the Winner not be in possession of a valid South African driver’s license, that Winner will be disqualified, and the Promoter will choose another Winner from the finalists.
    • 5.6 If the Winner does not collect the Prize on the arranged handover date and does not provide an updated expected collection date and time, then the Winner will forfeit the Prize, and the Promoter will move onto the next possible finalist.

  5. The Prizes & Draws:

    • 5.6. The Promoters are not responsible for any risk and / or damages that may occur once any of the prizes are handed over to the winner(s).
  6. Potential Winner Validation
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call or SMS from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative. Potential winners may also be required to provide a till slip proving purchase. Potential winners may be asked to provide all unique slips in the event that the entrants has entered more than once.
    • 6.2. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as the final winner. The final winner may be required to submit additional documentation as determined by the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a redraw will be executed subject to the terms and conditions herein. A potential prize winner will also have 48 hours to produce the relevant documentation before forfeiting the prize and a runner up being chosen.
    • 6.3. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their mobile number being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers or no answer, such a potential winner will be disqualified and a redraw will be executed.
    • 6.4. Eligible winners will have their prizes delivered, should a physical delivery be necessary. Should delivery of the prizes be unsuccessful after 3 attempts the prizes will be stored at BrandM8 and may be collected by the validated winner.
    • 6.5. The eligible winner of the Grand Prize 1 x signed FC Barcelona jersey will have their prize delivered to them by a representative of the Promotors based on the information they will have shared via the above-mentioned telephonic conversation.
    • 6.6. Eligible winners of standard replica jerseys will receive a voucher code via SMS which will be redeemable at the participating sports store which will be articulated to the eligible winner telephonically and in the SMS. Eligible winners will receive this communication from the Promotors on the telephone number which was used to enter the campaign based on the information they will have shared via the above-mentioned telephonic conversation.
    • 6.7. Eligible winners of soccer balls and back packs will have their prizes delivered to them by a representative of the Promotors based on the information they will have shared via the above-mentioned telephonic conversation.
    • 6.8. Eligible winners may be asked to complete an indemnity form for the protection of both the winner/s and Nestlé. Failure to complete the form would result in a participant forfeiting the prize.
    • 6.9. The choice of service providers and vendors, including but not limited to courier companies is at the sole discretion of Promoters.
       
  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.

All publicity and other materials will be the sole property of the Promoters.
    • 7.8. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.9. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.12. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
    • 7.13. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.14. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.

  1. Introduction
    • A. Participation in this competition (herein after the “Competition”) is governed by these terms and conditions (hereinafter the “Rules”).
    • B. Participants are encouraged to review the Rules before entering the competition and acknowledge that they have been given an appropriate opportunity to do so.
    • C. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (hereinafter “Nestlé”) in conjunction with Vetro Media (Pty) Ltd (hereinafter the “Promoters”).
    • D. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
  2. By participating in this Competition, Participants agree to the rules set out below.
    This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • A. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of the Promoters.
    • B. People who are not legal residents and/or legal citizens of the Republic of South Africa.
    • C. Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above.

  1. Introduction
    • 1.1. These Contest Terms & Conditions (which include the Contest Details) set out the basis for participating in the Contest identified below.

      Entry Instructions
      To enter, participants will be required to opt-in to the NESTLÉ NESPRAY WhatsApp Moment by sending a message that says ‘’Hi’’ to the following number on Whatsapp: 061 483 3559 and completing the Maths questions sent to them. Participants must complete at least 2x WhatsApp Moment Math questions in order to be eligible to be selected as winners of the Contest.
      Participants must look out for the announcement of winners on the NESTLÉ NESPRAYSA Facebook page;

      Entrant Requirements Minimum age to participate in the Contest: 18 years. An entrant under 18 years of age must be fully assisted by his/her guardian, who approves of and consents to the participant’s participation in the Contest and the participant’s receipt/possession of the prize;

      South African residents in possession of a valid identity document.

      Persons who may not enter the Contest:

      Any of the following:

      Selecting Winner(s)

      Determining Prize Winner(s): Participants who have completed at least 2x WhatsApp Moment Math questions will be eligible to be selected by means of a random draw and will be notified by message on WhatsApp and confirmed telephonically where the winners will be required to verify their details;

      The winners will be required to provide their name, ID number, copy of their identity document, proof of address, contact details and sign an acknowledgment of receipt of the Prize;

      Method of allocation where multiple Prize(s): Winners will be contacted every day for five (5) consecutive working days after the random draw. If they cannot be contacted during the given time, their Prize will be forfeited, and another winner will be selected by random draw;

      Basis of re-allocation if a Prize is not claimed: The Promoter will endeavour to contact the Prize Winner once every day for five (5) consecutive working days after their name is drawn. If the Prize Winner cannot be contacted during this period, the Prize will be forfeited, and another winner will be selected in accordance with the rules.   2. Contest Basis
    This Competition is limited to legal residents of South Africa. In addition, the following people shall not be eligible to participate in this Competition:
    • 2.1. The contest is
      a. open to those meeting the Entrant Requirements;
      b. not open to those falling within the description of Persons who may not enter the Contest (even if they meet the Entrant Requirements).
    • 2.2. You must follow the Entry Instructions.
    • 2.3. You must answer at least 2x Nestlé NESPRAY WhatsApp Moment questions. Entries must not be automatically generated by computer or otherwise submitted on an inappropriate basis (for example using multiple names, email or social media accounts to enter).
    • 2.4. You may only win one Prize, even where entering on behalf of others – only one Prize can be won by the group of persons/parties. The exception to this rule is where the Contest Details clearly and specifically allow multiple prizes to be won.
    • 2.5. The Promoter may at any time extend, suspend or terminate the Contest on reasonable cause (which may or may not relate to an entrant).
  3. Entries
     
    • 3.1. Entries that (i) do not comply with these Contest Terms & Conditions; or (ii) are incomplete, corrupted or late, may be rejected, disqualified, removed and/or deleted by the Promoter.
    • 3.2. Your entry includes any materials provided as part of or in relation to that entry. Where entry to the Contest involves provision of written, recorded, pictorial or other material in electronic or other form, you must ensure your entry:
      a. is (i) suitable for public access and in particular does not contain nudity, pornographic, religiously/culturally/politically insensitive or violent content; and (ii) not in breach of applicable laws;
      b. does not contain or refer to any products or brands other than NESTLÉ NESPRAY (unless such inclusion is entirely incidental, not prominent and is reasonably necessary due to the nature of the entry);
    • 3.3. You grant the Promoter (i) ownership of any entry; and (ii) a perpetual, irrevocable, worldwide, royalty-free, sub-licensable and transferable right to use, reproduce, distribute, and make derivative works of your entry, in any media and through any media channel. You will not grant these rights to any other party.
  4. Responsibility for Entries
    To participate in this Competition, Participants must adhere to the following:
    • 4.1. If you are submitting an entry on behalf of more than one person/party, you must ensure that you have authority to accept these terms on their behalf and ensure they comply with these terms.
    • 4.2. You must comply with these Contest Terms & Conditions and not otherwise unlawfully seek to misuse or tamper with the processes and rules of the Contest.
    • 4.3. You hereby indemnify and hold harmless the Promoter and other members of the NESTLÉ NESPRAY team (including their respective directors, officers and employees) in respect of all liabilities, losses and damages of any kind resulting from your breach of these Contest Terms & Conditions and/or your participation in this Contest. The Promoter excludes responsibility for those liabilities, losses and damages, although nothing in these Contest Terms & Conditions is intended to limit the Promoter's liability for (i) fraud; (ii) intentional misconduct; or (iii) for death or personal injury caused by its negligence (including that of its employees and agents)).
    • 4.4. You must indemnify and defend the Promoter and other members of the Nestlé NESPRAY team (including their respective directors, officers and employees) in respect of any third party claim that your entry or its use in accordance with these Contest Terms & Conditions breaches applicable laws, confidentiality obligations or intellectual property rights due to your breach of these Contest Terms & Conditions.
    • 4.5. The Promoter is not in any event responsible for:
      a. entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind or any other event which is either unforeseen or outside of the Promoter's direct reasonable control;

    Participants in this Competition stand a chance to win their share of amazing weekly and monthly prizes as well as be entered into the draw for the main prize. Participants are eligible to win only one weekly or one monthly prize but may be entered into the grand prize draw where they will be eligible to be a possible winner.
     
    • 5.1. The winner(s) will be notified using the method and within the timing set out in the Contest Details.
    • 5.2. The winner(s) must claim their Prize using the method and within the timing set out in the Contest Details. If the Prize is unclaimed after this time, the right to the Prize lapses and the Promoter may offer the Prize to a substitute winner selected in accordance with the method noted in the Contest Details (in the absence of specification, a fair basis which aligns closely with the winner selection method).
    • 5.3. The Promoter may (at its discretion or where required by law) provide or publish details of the winner(s) (name and county). Requests for provision/publication should be sent to the Promoter contact details in the Details Sheet no later than within ten weeks after the Contest closing date.
    • 5.4. In the event of any uncertainty or difference of opinion regarding the administration of the Contest (including the award of Prizes), the decision of the Promoter is final (this does not remove any legal rights).

  6. Prizes:

    • How to claim your prize:
      • 6.1.     • Potential Winner Validation
      • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipt/s) and a copy of his/her South African ID and/or driver’s license to the Promoters representative.
      • 6.2. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as the final winner. The final winner may be required to submit additional documentation as determined by the Promoters.       • 7.1. The judges’ decision is final, and no correspondence will be entered into.
      • 7.2. The Promoters may require the winners to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should a winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited.       • 7.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
      • 7.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
      • 7.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
      • 7.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
      • 7.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
      • 7.14. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
      • 7.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.

The promotional competition is open to all South African residents and are in possession of a valid identity document, except any director, member, partner, employee, agent or consultant of the Promoter, the marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members.
    This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:

  12. Any prize not taken up for any reason within two months of notification will be forfeited.
  13. The winner and their travel partner must be in possession of a valid passport for the purposes of international travel. Passports are required to be valid for at least six months after the date of return to South Africa and to have no less than two full blank pages available in the passport. The winner and their travel partner must be permitted to travel to the specified destination by the relevant authorities.
  14. The winner shall forfeit the prize in the event that for any reason whatsoever, the winner is prevented or unable to travel to the specified destination or on the specified dates and/or fails to meet the VISA application criteria (if applicable).
  15. The choice of service providers and vendors, including but not limited to accommodation and flights is at the sole discretion of Promoters.
  16.   18. Winners will be selected by means of a random draw by 7 August 2019 and will be notified telephonically where the winner will be required to verify their details. The Promoter (or their agent) will endeavor to contact the prize winner once every day for 5 consecutive working days after their name is drawn. If the prize winner cannot be contacted during this period, the prize will be forfeited and another winner will be selected in accordance with the rules.
  19. The prize includes delivery and winners will be required to provide the Promoters with a valid day time delivery address to enable delivery.

    • 4.4. Winners will be determined by random draw that will be held on a weekly basis during the campaign period (1 May – 31 July 2019). The draw for the Main Prize winner will be held on the 2nd of August 2019. All draws will be held in the presence of the Nestlé brand team and Nestlé legal team.
    • 4.5.     • 5.2.5. The Promoters are not responsible for any risk and / or damages that may occur once the C200 is handed over to the winner. The winner will be required to sign an indemnity form acknowledging this when the C200 is handed over.
    • 5.2.6. The Promoters will not partake in any sort of deals if the winner decides to sell the C200 once it has been handed over to the winner. The winner takes full responsibility for the selling of the C200 and the risks associated with the sale.
    • 5.2.7. The C200 will be delivered to a selected Mercedes Benz Dealership. Nestlé, the organisers of the competition and the promoters are not responsible for travel costs for the winner to get to the selected Mercedes Benz Dealership to collect the C200. The winner will be required to bring all relevant documents upon handover of the C200.
    • 5.2.8. The C200 will be delivered within two months of the date which the draw took place. Nestlé will contact the winner should the delivery be delayed for whatsoever reason and the winner shall have no claim against Nestlé for any such late delivery.
    • 5.2.9. The winner must collect the C200 within 2 weeks from the C200 being delivered to the relevant Mercedes Benz Dealership and a failure to do so will result in the winner forfeiting the prize, without any claim or recourse against the Promoters.
       
  6. How to claim your prize:
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative.
    • 6.2. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.3. If the Promoters are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.4. Eligible winners will have their prizes delivered to them by a representative of the Promoters based on the information they will have shared via the above mentioned telephonic conversation.
       
  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found, in the Promoters sole discretion: not to be eligible to win; not to have complied with these Rules; their conduct can be reasonably interpreted as scamming; acted fraudulently with regards to the Competition; and if it would be unlawful to award the prize, he/she will automatically be disqualified and/or the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prize is not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
    • 7.6. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing [email protected] Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.7. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.8. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.9. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.10. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.11. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.12. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Competition and acknowledge that they will have no recourse against the Promoters, their advertising agencies, advisors, suppliers and nominated agents.
    • 7.13. By entering the Competition, Participants acknowledge that the Competition will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.14. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.15. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.

  1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
    • 1.2. Participants are encouraged to review the Rules before entering into the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these Rules.
    • 1.3. This competition is operated by Nestlé (South Africa) (Proprietary) Limited (“Nestlé”) in conjunction with JustPalm (Proprietary) Limited (the “Promoters”).
    • 1.4. Participation in the Competition constitutes acceptance of these Rules and Participants agree to abide by these Rules.
  2. By participating in this Competition, Participants agree to the rules set out below.
    This Competition is limited to legal residents and/or legal citizens of the Republic of South Africa. In addition, the following people shall not be eligible to participate in this Competition:

        • The vehicle will be delivered before the end of the month within which the draw took place. Nestlé will contact a winner should the delivery be delayed for whatsoever reason and the winner shall have no claim against Nestlé for any such late delivery.
        • Winners must collect the vehicle within 2 weeks from the vehicle being delivered to the relevant dealership and a failure to do so will result in the winner forfeiting the prize, without any claim or recourse against the Promoters.
    • 6.3. Participants in the retail version of the campaign stand a chance to win one of the following grand prizes;
      • 1 of 8 x Shotleft travel prizes (Not transferrable for cash). Each Shotleft travel prize will comprise of a weekend getaway to any destination in South Africa for a family or group of 5 people (subject to a limit of R50 000 per trip). Each trip will include return economy flights, accommodation and selected meals. The prize excludes optional excursions (unless specified otherwise), all items of personal nature, gratuities, meals and beverages other than specified, and any other items not noted in the inclusions. All spending money is for the winner’s own account and no cash will be handed over to the winner. All travel will need to be completed by 30 November 2019 (the “travel period”). Once the winners of the Samsonite luggage sets and Shotleft travel prizes have been verified, these winners will each have an opportunity to select 2 people that they would like to win bus travel vouchers of R1500 each (“nominated participants”). The nominated participants will be contacted and they will be required to purchase participating products as contemplated in 4.1 above and provide the Promoters with a copy of their till slips. Following a successful verification process, the nominated participants will be awarded their prizes.
       
  7. How to claim your prize:
    • 7.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipt/s) and a copy of his/her South African ID and/or driver’s license to the Promoters representative.
    • 7.2. A potential prize winner is not an actual winner at the time of being contacted. Contact is made with a potential prize winner to ensure that the required receipt/s is available. Once the till slip has been supplied and validated, the mobile number of the potential winner is placed into a randomised draw process from which they could be selected as the final winner. The final winner may be required to submit additional documentation as determined by the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a redraw will be executed subject to the terms and conditions herein. A potential prize winner will also have 48 hours to produce the relevant documentation before forfeiting the prize and a runner up chosen.
    • 7.3.     • 8.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules.     • 8.8. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.

The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 8.10. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 8.11. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 8.12. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA.   1. Introduction
    • 1.1. Participation in this Competition is governed by these terms and conditions (the “Rules”).

  6. How to claim your prize:

          • The Promoter will not be responsible for any additional baggage, cancellation or booking amendment fees.

      • 5.4. If a Participant’s name is drawn, they will be contacted within 1 week of the date of the relevant draw.
      • 5.5. The Promoters are not responsible for any risk and / or damages that may occur once any of the prizes are handed over to the winner(s).
         
  6. How to claim your prize:
    • 6.1. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as proof of purchase (receipts) and a copy of his/her ID and/or driver’s license to the Promoters representative. Potential winners may also be required to provide a till slip proving purchase.
    • 6.2. Consumers that are contacted and requested to provide details are not winners but are rather shortlisted as potential winner/s.
    • 6.3. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promotors. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.4. If the Promotors are unable to reach any of the potential prize winners after 3 (three) attempts made within 3 (three) working days of their name being drawn, for whatsoever reason, including incorrect telephone numbers or inoperative telephone numbers, such winner will be disqualified and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein.
    • 6.5. Eligible winners will have their prizes delivered to them by a representative of the Promotors based on the information they will have shared via the above-mentioned telephonic conversation.
    • 6.6. Eligible winners may be asked to complete an indemnity form for the protection of both the winner/s and Nestlé. Failure to complete the form would result in a participant forfeiting the prize.
    • 6.7. The choice of service providers and vendors, including but not limited to accommodation and flights is at the sole discretion of Promoters.
       
  7. General
    • 7.1. The judges’ decision is final, and no correspondence will be entered into.
    • 7.2. The Promoters may require the winner to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these Rules. Should the winner be found not to have complied with these Rules, he/she will automatically be disqualified, and the prize will be forfeited. Winners may also be required to sign acceptance of prizes and indemnity documents.
    • 7.3. The prizes are not transferable, and no substitution or cash redemption of prizes is permitted. The prize will not be handed/awarded to a third party, but only to the verified prize winner.
    • 7.4. The Promoters reserve the right, at their sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
    • 7.5. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
    • 7.6. Product images depicting the prizes are for illustrative purposes only and may differ from the actual prizes.
    • 7.7. By entering this Competition you authorise the Promoters to collect, store and use (not share) personal information of Participants for communication or statistical purposes. You are entitled to decline any marketing communication by emailing [email protected] . Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Nestlé’s privacy policy.
    • 7.8. Participants may be required to take part in publicity campaigns for broadcast or publishing purposes. Participants shall at all times be entitled to decline the above request. Participants that take part in any publicity will not be entitled to any payment or other remuneration for such publicity or otherwise. All publicity and other materials will be the sole property of the Promoters.
    • 7.9. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    • 7.10. All Participants participate entirely at their own risk. By reading and accepting these Rules, the Participants give consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.
    • 7.11. The Promoters, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Participants, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.
    • 7.12. The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.
    • 7.13. The Promoters reserve the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.
    • 7.14. By entering the Competition, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have forfeited the prize.
    • 7.15. Notwithstanding anything to the contrary contained in these Rules, the Promoters reserve the right to amend, modify, change, postpone suspend or cancel this Competition, the Rules and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which the Promoters deem necessary. At the end of the Competition for whatsoever reason, all of the Promoters’ obligations in regard to the Competition as well as in regard to the prizes shall cease to exist.
    • 7.16. These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Participant and Nestlé consent to the non-exclusive jurisdiction of the High Court of South Africa.
